Waiver, Release, and Hold Harmless Agreement
By leaving my property with Cascadia Mobility, I affirm that I am over the age of eighteen and have the legal capacity to agree to this Waiver, Release, and Hold Harmless Agreement (“Agreement”) and I represent covenant and agree, on behalf of myself and my heirs, assigns, and any other person claiming by, under, or through me, as follows:
Use of Service: By using our bike valet and item check service, you agree to comply with these terms and conditions. You must follow the instructions of our staff and use the service in a responsible manner.
Responsibility: While we take every effort to ensure the security of your bike and/or item, we cannot be held responsible for any loss or damage that may occur. If you are not comfortable with the risk you should not use our service.
Liability: We shall not be liable for any indirect, incidental, or consequential damages, or any loss of property, profits, revenue, or data arising out of or in connection with the use of our service.
Release of Liability: By using our bike valet and item check service, you agree to release us, and the client(s) for whom Cascadia Mobility is providing its services, from any liability arising from the use of our service.
Indemnification: You agree to indemnify and hold us harmless from any claims, damages, or losses arising out of or in connection with your use of our bike valet and item check service.
Modification: We reserve the right to modify these terms and conditions at any time. Any changes will be effective immediately upon posting on our website or at the event or location.
Governing Law: These terms and conditions shall be governed by and construed in accordance with the laws of Lane County, Oregon.
Bikes and items must be picked up within 30 minutes of the event’s completion (unless posted otherwise).
After this time, remaining bikes and items left with Cascadia Mobility are subject to a $50 reclamation fee. Please contact us at valet@cascadiamobility.org to arrange for payment and pick-up.
Entire Agreement: These terms and conditions constitute the entire agreement between you and us and supersede all prior agreements, understandings, and negotiations, whether oral or written.
By way this Agreement, I understand and agree that if my property is lost or damaged while in Cascadia Mobility’s possession, I have waived my right to maintain a lawsuit against Cascadia Mobility and the clients for whom Cascadia Mobility is providing its services.
